some small creeks and streams are falling faster than normal, the result of a deluge over the weekend. that is true of the russian river as well. so those trees over there, 20 feet high. those trees under the water. >> the owner of river bend rv park -- the russian river made it to 30 feet, short of flood stage at this location, but george had to move several of his rv guests to higher ground as the russian river got higher. it's dropped several feet just since this morning. a trend that he doesn't think will change much with this latest round of rain. >> i think it will come up a little bit but it it won't be quite as much. >> reporter: i talked to a fire chief with the san rafael fire department. he says that rising creek levels with this latest storm is not really the concern. it's the rain hitting already saturated soil. they will be watching for

potential landslides. back to you. to the south bay, we're in the santa cruz mountains where they've been work to be repair a washed-out road. >> reporter: by this hour a lot of people who live up here were hoping to be able to drive on this spot where i'm standing. we spent the day with crews who were trying to make that happen. you can see why those hopes eroded quickly. work crews trying to reopen vine hill road was an encouraging sight for people in the santa cruz mountains near scott's valley. >> it's scary. that was all vegetation and trees. it looks so solid. it really did. that's scary. >> county officials say restoring vine hill to a one lane road is a top priority because it's a crucial connection to highway 17 and silicon valley. >> we were hoping to get it

open today but had a few more complications, had to lay some more pipe in the ground, more than we thought. it should be open by tomorrow afternoon. >> some say if that doesn't happen -- >> for the locals this will add 15 minutes to any trip that has to go to the valley. >> once the temporary repair work is done, officials will monitor the hillside to see how it's holding up. if all goes well, restoring vine thoil two lanes could be done in about a month. if not therks say a permanent fix could be four to five months down the road. >> it's the weather. we can't really open up the ground there and do any digging with a lot of rain forecasted and all. this is not worth the chance. you are just aggravating the site. >> one lane is making me nervous. >> a lot have heavy trucks were on this section today. that should inspire some confidence. those trucks will resume work tomorrow morning weather

permitsing. back to you. a caltrans is hoping tonight's rain will not cause more damage along highway 1 in san mateo. crews worked to stabilize erosion from the weekend storm in pacifica. one way traffic controls were in place during the day after a complete closure overnight. caltrans said that the work would be finished by 3:00 p.m. today and all lanes reopened. a tree that fell over in live more was removed today. two vehicles were crushed and trapped by that tree. the tree fell over yesterday after. it was all cleaned up by 1:00 p.m. today. crews fixing a giant sink hole in lafayette say it may take until next spring for permanent repairs. this is new video from this afternoon. an 80-food long section of the road collapsed sunday because of an overflowing storm drain. crews are working on a temporary fix but say the detours will likely be in place

until repairs are finished in the spring. there are some showers up in the north bay right now. the far north bay. this is not a huge weather event. the rain that we saw a few days ago, major stuff. what's coming now, i'd call it nuisance showers, maybe a little more. it will impact the morning commute. the showers are north of santa rosa. we're getting reports of sprinkles up there, 45-50 miles from the central bay. the santa rosa area, up by fulton road we have some showers. that's moderate rainfall. by old redwood highway we have showers. st. helena, moderate showers to light. just coming into the sunset district, i have some light sprinkles moving in. you can see that's the cliff house area. in that area we're seeing some light sprinkles. that's sort of what's out there now.

temporarily recess this meeting. >> nudists protested as san francisco supervisors gave their final approval to a ban on public nudity. the nudists are anticipating a court battle to restore what they see as their first amendment rights. >> we will continue fighting this no matter what it takes until this legislation is dead. >> one supervisor says he created the ordinance after years of complaints primarily from gay men living in the castro district. >> it will still be legal to be nude on a beach, to be nude at folsom street fair, bay to breakers, pride. >> been a takes effect february 1. >> there are so many families and people who have told me they're really sorry they can't come to the neighborhood anymore because of this. >> for others public nudity is what makes san francisco and the castro district unique. >> castro's fabulous. everything goes here. anything goes.

so if you are offended by nudity, you should stay home. >> the ban passed today 7-4. one supervisor said she made a mistake. in a revote she changed her vote to oppose the measure. it still passed by one vote. back to you. a family owned oyster company at point reyes national seashore today sued the federal government for the right it to stay in that park. owners of the drake's bay oyster company are angry that the interior secretary has refused to renew their special use permit to operate the company inside the park. the suit claims the government's environmental impact review violated federal rules and failed to provide enough public notice. park service staff claim the oyster company endangers the wild nature of point reyes national seashore. the strange saga of john mca fee continues today with

word he is in guatemala seeking asylum. the anti-virus software founder posted a message on his blog today saying he escaped from belize. he says he is meeting with guatemalan officials today and if all goes well he'll do a press conference tomorrow. authorities in belize want to talk to him as a pen of interest in the murder of his neighbor. he claims he's innocent. sonoma county firefighters are work to be determine the cause of a fire that left a house a total loss. crews from twelve agencies raced to stadler lane outside petaluma about 3:30 a.m. the house of engulfed in flames. firefighters say no one lived there. the yard was covered with things such as twelve vehicles, a boat and even a camper. contra costa county's former top vice officer is now expected to plead guilty in connection with a scheme to sell confiscated drugs on the

street. and plea deal, norman wielsch will plead guilty to tomorrow to five counts including theft and conspiracy to distribute marijuana and methamphetamine. under terms of the deal he will get no less than ten years in prison when he is sentenced in february. the former commander along with former concord private investigator christopher butler were both indicted last year for allegedly stealing drugs, operating a brothel, and conducting phony sting operations to rob prostitutes. butler has already pleaded guilty and is in prison. oakland police report the arrest of a suspect in a shooting that left a man in serious condition this morning. police say it happened just after 9:00 a.m. near east 31st street and 13th avenue. they say that the suspect shot the victim several times, then ran off and jumped into a car. police did get the license plate number from a witness and caught up with him near the fruitvale district at about 10:30 a.m. they have not yet released the name of the suspect but say a gun was thrown from his car.

coming up at 5:30, what oakland police are saying today about the suspect arrested for an attack on an autistic teenager. a big jump in home prices shows the housing market is bouncing back. there was a 6.3% increase in october compared to a year ago. prices were up in a total of 45 states including california. we saw a 9% gain. at 6:00, there are signs after housing boom in one east bay community. the unusual call some homeowners are receiving from realtors. on capitol hill today republicans and democrats squared off over the looming fiscal cliff. house minority leader nancy pelosi slammed the gop's proposals. >> that's not negotiating. that's hostage taking. >> pelosi and other democrat respect pushing for president obama's plan. it would extend the bush tax cut for the middle class but

door has a history. its connection to some of the music legends of the 1960s. it's one of the biggest seizures of methamphetamine in u.s. history. the announcement came from federal officials in san francisco. the u.s. attorney said the drug haul came as agents arrested eleven people last friday on drug, money laundering and weapons charges. she says more than 570 pounds of method mean was seized. it has a street value of $6 million. the suspects were rounded up in counties from the bay area, the central valley, santa cruz and monterey. four san francisco high school students today shared top honors for producing an anti-bullying video. >> when you get bullied as a child, you feel miserable and unwanted ?oomple the san francisco district attorney's office sponsored the bye-bye bullying contest. students submitted 58 films designed to discourage bullying. a team from st. ignatious high

fully engulfed. police say this is probably a stolen car that has not been reported. the tires had been taken off the car before it was burned. biologists are trying to figure out what was wrong with two mountain lion cubs. they were forced to shoot and kill them. they were shot in downtown half moon bay saturday. they were behavioring abnormally with plank stares and didn't run when approached. fish and game said for the safety of others the animals were killed. an internet company has settled lawsuit with a former employee on the value of twitter followers. we introduced you to noah kravitz last year. his lawyers say he has settled with phone dog.com which reviews mobile devices. phone dog sued kravitz. it says that he cost the company thousands of dollars in lost when he resigned and took 17,000 twitter followers with

him. terms of the settlement were not announced. kravitz will keep control of his twitter account. >> bill martin has been very busy in the weather center all afternoon. you are tracking some rain, nothing like what we just went through. >> that was a ten. this will be a three in terms of rainfall. we're getting light sprinkles up north. it's real light stuff. you look at the radar, you look up north, you will see that's where the heaviest rain is. the rain for us, we're seeing light areas of some sprinkles especially out along the coast. we go in here close and come up by santa rosa. it's north of town. those yellows represent some moderate rainfall, real light. we had a few showers out there earlier this evening. if we look out further, you can see showers by bayview over by bayshore boulevard, geneva

avenue. it's sprinkle, light, light, light stuff. that will change. the real weather system, the bulk of it will roll in here as with we get into the late evening hours, early morning hours. so this shot of shower activity we'll see now is more for our latitude, more nuisance, scattered showers tonight there. is heavy rain occurring up in this area. for us just nuisance showers. by tomorrow morning they'll ramp up a little bit. then they really will be a nuisance. it will be on the morning commute. that will slow things down. lots of moisture streaming through. it got a little buckle in the jet stream right here. that's going to be enough to really keep everything the main dynamics north of us. we'll see sprinkles, but not as heavy as they could be if that were to sag down. tonight at 11:00 p.m., this is when the showers will get here, widely scattered showers. santa rosa will have moderate to light rain. we'll see drizzle, light rain, sprinkles in oakland and

energy particles and radio waves. eight years after it landed on mars, nasa's rover opportunity is still making discoveries. scientists announceed today at the american geophysical union meeting in san francisco that the rover has uncovered hints of clay mirals. they're important because they hold clues about the martian climate and should help scientists figure out if surface conditions could've been favorable for life. the use of drones in war zones has stirred global debate. now an east bay law enforcement agency is drawing fire for its plan to launch a drone in their community. >> we should not be rushing headlong into buying a drone before the safeguards are in place, before the county has decided it should get a drone. >> american civil liberties union spoke out against the drone plan today just before the alameda county board of supervisors took up the issue. the sheriff hopes to buy an unmanned aerial system or drone using a state grant. it has hd video and infrared

>> reporter: firefighters say the unusual amount of electrical equipment in that home created an extra hazard for them. it's that home you see behind the corner home. police have not spoken to the tenants who live there. they could be facing several felony charges. firefighters cut into the rooftops of two homes in the haight this afternoon to stop a fire brewing in their attics. investigators believe it started near a marijuana grow operation in this green home, then spread to the home next door. it's never a surprise when these grows go up in smoke. >> all these grows, they bypass the pg&e, so you are running a lot of what aage with no regulation. a lot of exposed wiring and it's been our experience that usually they catch on fire eventually. >> interestingly, the home on the corner that was also affected was the subject of a documentary done by cbs tv back

government is tracking the number of emergency room visits caused by synthetic marijuana or what's can commonly called k2 or spice. the drugs were linked to more than 11,000 hospital visits in 2010. they can cause seizures and hallucinations. the sale of synthetic drugs is illegal in a number of states including california. a political scandal in the south bay, a santa c larks ra county supervisor has been ordered to reimburse the county for $13,000 in expenses. an internal audit found the board president used a taxpayer funded credit card for personal expenses. that included golf fees, casino hotel stays, and rental card -- car upgrades. he said he will reimburse some of the expenses but is defending some of the other expenditures. today the oakland police department talked for the first time about the arrest in an

assault on anna toc particular girl. paul chambers spoke with the police chief. the chief is not mincing words. >> that is correct. oakland police won't give many details about this open active investigation. there were strong words today from the chief. >> this is by far one of the most sickening cases i've seen in my career as a police officer, that someone as mr. atkinson can take advantage of of someone of this stature. >> look at this man. he's 36-year-old gary atkinson of san francisco. today he was charged with several criminal counts including kidnapping with force and three covents rape of a 16- year-old severel autistic girl who according to her father has the mental capacity of a 6 or 7- year-old. police say last tuesday around 7:00 p.m. the 16-year-old left fred finch facility and headed toward the fruitvale bart station. she was followed by youth center employees who lost

sieghtsd of her. 48 hours later she was found found on a muni train in san francisco. surveillance cameras helped identify atkinson who was arrested sunday night near the same bart station. he does have a criminal record. >> some of our officers recognized mr. atkinson. they then based on the photo that was sent out was able to identify mr. atkinson. some of our officers have had previous contact with him. >> police wouldn't say what his prior crimes are but a court clerk says he does have one felony conviction. back to you. oakland council members are scheduled to tackle the ongoing dog fight over astro park at tonight's council meeting. the planning commission has denied a previously approved proposal to make the corner of macarthur and lakeshore into a fenced dog park. supporters of the dog park are appealing this decision to the city council.

government's abuse of power. more than 100,000 egyptians took part in the protest breaking through bashed wire around the palace. a nationwide referendum on the controversial draft constitution is set for december 15. egyptian media will shut down tomorrow to join the protest. nato members agreed today to deploy a patriot anti- missile system in turkey to protect the country against any crossfire from syria. this comes as syrian rebels released a video reportedly showing air attacks by government fighters and heavy damage to buildings in damascus suburbs. the obama administration is hoping that russia will goin the international community in forming a coalition against syria's president. >> we want to work with russia as we've said many times on the

the state attorney general issued a bulletin to all law enforcement agencies today telling them they do not have to comply with a federal immigration program. attorney general camila harris says the immigration and customs for the program called secure communities is unconstitutional. she's telling police across the state to enforce it under their own discretion. secure communities instructs law enforcement to hold

undocumented immigrants until ice can pick them up. critics say this just clogs jails and nets too many people who are not criminals. >> this will make clear to them that they have the right to release, those undocumented immigrants, if they believe that that's in the best interests of of public safety in their community. >> the attorney general says from march to june of of this year in california, 28% of the undocumented workers held turned out to be noncriminals. a california icon gets a makeover. renovations on the famous hollywood sign are done. the nine week facelift include add fresh coat of white paint. it's owned by the city of los angeles and was refurbished thanks to the hollywood sign trust fund and sherwin williams which supplied the paint. the bright light was broadway shined this year. 2012 was the best year for broadway. it just passed $1.2 billion in ticket sales. 60% of that came from tourists.

flounder before the fda approves the sale of their fish. aqua bounty was set to become the world's first company to sell fish that has dna that has been altered to speed up growth. despite a multiyear review, the fda still has not given final approval. the decision could take months or years. the c.e.o. of aqua bounty says the company may run out of money before that approval comes. internet radio pandora is offering a bleak forecast for the next year. they posted better than expected third quarter results but said they expected a full year loss for the fiscal year that ends in january. pandora shares slid more than 18% in after hours trading. this is their latest stock diver due to increasing concerns about competition from apple. netflix is adding newly released movies to its streaming service, but not until 2016. they inked a deal with disney that takes licensing rights away from stores at the end of
